Welcome to Somni. These Terms and Conditions ("Terms") govern your use of the Somni mobile application (the "App"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please refrain from using the App.

1. Data Collection and Privacy

1.1 Anonymity and User Identification

• Somni does not collect any personally identifiable information such as names, surnames, phone numbers, or email addresses.
• A unique identifier is generated for each user, which is used for processing activities within the App.

1.2 Device Information

• Device language
• Device brand and model
• Operating system version
• Regional settings

1.3 Personal Data Storage and Security

User-generated content is stored in AWS Aurora Serverless PostgreSQL v2 and Redis instances located in the EU-WEST-1 (Ireland) region. Communication between the App and backend services is via a virtual container hosted on AWS EU-WEST-1.

1.4 Third-Party Services

Somni uses OpenAI services to provide AI-powered features. User content may be processed by OpenAI's API in accordance with their privacy policy and data processing terms. OpenAI does not retain user data for training purposes when using their API services.

2. User Rights and Account Deletion

2.1 Account Management

• Users can delete their accounts at any time via the App settings.
• Upon account deletion, all associated data will be permanently erased.

2.2 Data Retention and Processing

The App does not retain user data beyond the active period of the account. No user data is shared with third parties.

3. User Responsibilities

3.1 Acceptable Use

• Users agree to use the App solely for its intended purpose.
• Any unauthorized or malicious use, including security breaches, is prohibited.

3.2 Age Restriction

Users must be at least 18 years old or have parental/guardian consent.

4. Service Availability and Limitations

4.1 Service Provision

The App is provided on an "as is" and "as available" basis. No guarantees are made for uninterrupted service.

4.2 Modifications and Updates

We reserve the right to modify or discontinue features at any time without notice.

5. Limitation of Liability

5.1 No Warranty

Somni disclaims all warranties, express or implied.

5.2 Liability Limitation

To the maximum extent permitted by law, Somni is not liable for any damages arising from App use.

6. Governing Law and Dispute Resolution

6.1 Applicable Law

These Terms are governed by the laws of Turkey.

6.2 Dispute Resolution

Disputes will first be resolved through negotiation, otherwise settled via legal process.
